Giving Victims a Voice: Victim Impact Statements
Since the emergence of the victim rights’ movement in the 70’s, there has been growing awareness about the importance of including victims in criminal proceedings. Nowadays, in most common law jurisdictions and in some civil law jurisdictions, victims have the opportunity to speak up about the impact crime has had on their lives through a victim impact statement/ victim personal statement. In the past, criminal proceedings focused exclusively on the offender, leaving no space for victims to share with the court their lived experience of crime.
Nowadays, victim impact statements can help determine the seriousness of the crime and the appropriate sentence. They also have a therapeutic function by enabling victims to express their emotions. In more practical terms, they can aid judges in deciding on adequate compensation.
Although Malta lacks a specific framework for victim impact statements, Victim Support Malta has worked/works with victims to produce victim impact statements.
